Het arbeidshof Mons heeft op zijn beurt het begrip oneerlijke concurrentie ingevuld (ar beidshof Mons 3.2.2004 J.T.T.2004, 288).

Eenmaal de arbeidsovereenkomst beëindigd, en uitgaande van de afwezigheid van een verbintenis tot niet concurrentie, herwint het principe van vrijheid van arbeid en van concurrentie haar volle werking. In die hypothese is enkel een oneerlijke concurrentie of deloyale concurrentie verboden. Het hof van beroep te Liège poneerde dit principe en toetste verder in concreto wat als oneerlijke concurrentie kan worden aange merkt. (hof van beroep Liège 20.1.2003, R.R.D 2003,154)
