5.1 The software program that controls the microcontroller can be identified by turning the key switch on while both push button switches below the LCD are depressed. The LCD displays the software version “40”. If the operator continues to hold both push button switches down after “40” is displayed the LCD will display the total number of pulses on the unit. The number displayed in the right column of the LCD represents 10,000 pulses. The number in the left column represents 100,000 pulses. A reading of “07” indicates are between 70,000 and 80,000 pulses on the XRS-3.
5.2 The operator can change the control module defaults for use with film or video imaging systems by changing the position of the software mode selector switch. The selector switch is accessed by removing the cover on the rear of the XRS-3. Using a T-10 Torx driver, remove the five screws and carefully pull the cover out until you feel resistance. The selector switch is located in the upper left-hand corner (Fig. 1).
5.2.1 In the A position, the XRS-3 will default to "00" on the LCD when the key is turned on. This position is best for use with film systems.
5.2.2 In the B position, the XRS-3 will default to "99" on the LCD when the key is turned on. This position is best for use with video imaging systems.
5.3 The software program in the control module is capable of indicating two conditions:
5.3.1 The first condition is detected if there are more than .33 seconds between two consecutive pulses.
5.3.1.1 The XRS-3 continues the current pulse train to “00”.
5.3.1.2 After the XRS-3 stops pulsing, the LCD will go back to the original pulse setting, but the left and right digits will blink alternately.
5.3.1.3 The condition indicates a low battery.
5.3.1.4 The XRS-3 will be inoperable until the key switch is turned off and on, or the battery is replaced.
5.3.2 The second condition is detected if there is more than 1 second between two consecutive pulses.
5.3.2.1 The XRS-3 stops pulsing immediately and the LCD displays “00”.
5.3.2.2 This function prevents XRS-3 from pulsing continuously if there is a failure in detecting circuitry.
5.3.2.3 This condition may indicate a low battery, electrical noise, or failure in detecting circuitry.
5.3.2.4 The operator may need to replace the battery pack, turn key switch off and on, or send the XRS-3 back for repair.

Source text - English 8 PROPRIETARY RIGHTS AND CONFIDENTIALITY
8.1 Ownership of Products. COMPANY and its licensors shall retain all right, title and interest in Products throughout the world, including without limitation, patent, copyright and trade secret rights. Except as expressly set forth in Section 3, neither this Agreement, nor any license of Products hereunder shall be construed as granting to VAR any license or other right in or to any patent, copyright, trademark, trade secret, or other proprietary right of COMPANY or its licensors.
8.2 Commercial Information. Notwithstanding provisions of subsection 8.3.2 below, all commercial information collected by COMPANY as a result of or in connection with this Agreement may be used or exploited commercially by COMPANY, including but not limited to information gathered by COMPANY pursuant to Section 7.1 of this Agreement.
8.3 Confidential Information.
8.3.1 "Confidential Information" means any information, in whatever form received by either party (the "Receiving Party") from the other (the "Disclosing Party") that is identified in writing as being proprietary or confidential to the Disclosing Party, provided, however that Confidential Information shall not include information which (a) is or becomes publicly available through no act or omission of the Receiving Party; (b) is rightfully received from a third party without any breach of obligation of confidence; (c) is independently developed by the Receiving Party without reference to Confidential Information; or (d) is required to be disclosed in accordance with a judicial or governmental order or decree, provided that the Receiving Party provides prompt notice of the order or decree to the Disclosing Party and reasonably cooperates with the Disclosing Party to limit the disclosure and use of the Confidential Information.
8.3.2 The Receiving Party will hold any Confidential Information in strict confidence for a period of three (3) years from the date of receipt of such Confidential Information and will use such Confidential information only in accordance with the terms of this Agreement. The Receiving Party shall limit the use of, and access to, the Confidential Information to its employees or agents whose use of or access to the Confidential Information is necessary to carry out the intent of this Agreement. The Receiving Party shall, by appropriate means, prevent the unauthorized disclosure, publication, display or use of any Confidential Information. Without limiting the generality of the foregoing, the Receiving Party shall require all employees, agents, or contractors who shall have access to the Confidential Information to execute, prior to such access, a non-disclosure agreement providing for at least the same protection of the Confidential Information as is provided for by this section. VAR shall not remove any trademark or copyright, restricted rights, limited rights, proprietary rights or confidentiality notice included in or affixed to Products, any promotional materials or any Confidential Information of COMPANY and shall reproduce all such notices on any copies of Products, promotional material or Confidential Information of COMPANY made by VAR in accordance with this Agreement.
8.4 Injunctive Relief. It is expressly agreed that a breach of Sections 3 and 8 of this Agreement by VAR will cause irreparable harm to COMPANY and VAR acknowledges that there would be no adequate remedy at law. Therefore, in addition to any and all remedies available at law, COMPANY shall be entitled to a preliminary injunction and/or other equitable relief or provisional measures of any kind without the necessity of posting any bond or undertaking in connection therewith to prevent any further breach of this Agreement or further unauthorized use of its Products and Confidential Information or to preserve evidence relevant thereto.
Translation - Spanish 8 DERECHOS DE PROPIEDAD INTELECTUAL Y CONFIDENCIALIDAD
8.1 Propiedad de los Productos. La EMPRESA y sus otorgantes de licencias se reservan todos los derechos, títulos e intereses con respecto a los Productos en todo el mundo, incluyendo, a mero título enunciativo, los derechos de patente, derechos de autor y derechos de secreto comercial. Salvo lo expresamente establecido en la Sección 3, ni el presente Contrato ni ninguna licencia de los Productos en virtud del presente, se interpretará como una concesión a favor del VAR de cualquier licencia u otro derecho a cualquier patente, derecho de autor, marca registrada, secreto comercial, o cualquier otro derecho de propiedad intelectual de la EMPRESA o sus otorgantes de licencias.
8.2 Información Comercial. Sin perjuicio de las disposiciones de la subsección 8.3.2 a continuación, toda la información comercial recolectada por la EMPRESA como resultado de o en relación a este Contrato podrá ser utilizada o explotada comercialmente por la EMPRESA, incluyendo, a mero título enunciativo, la información obtenida por la EMPRESA con arreglo a lo dispuesto en la Sección 7.1 del presente Contrato.
8.3 Información Confidencial.
8.3.1 "Información Confidencial" se refiere a cualquier información, en cualquier forma, que reciba cualquiera de las partes (la "Parte Receptora") de la otra parte (la "Parte Divulgadora"), identificada por escrito como confidencial o de propiedad de la Parte Divulgadora, siempre y cuando, sin embargo, la Información Confidencial no incluya información que (a) fuera o se hiciera disponible públicamente a través de cualquier acto u omisión de la Parte Receptora; (b) fuera legítimamente recibida por un tercero sin que hubiera violación alguna de la obligación de confidencialidad; (c) estuviera desarrollada de forma independiente por la Parte Receptora sin hacer referencia a Información Confidencial; o (d) fuera necesario divulgarla en conformidad con una orden judicial o gubernamental o un decreto, siempre que la Parte Receptora le brindara rápida notificación de la orden o el decreto a la Parte Divulgadora y cooperara razonablemente con la Parte Divulgadora para limitar la divulgación y el uso de la Información Confidencial.
8.3.2 La Parte Receptora mantendrá toda Información Confidencial en la más estricta confidencialidad durante un periodo de tres (3) años a partir de la fecha de recepción de dicha Información Confidencial y solo utilizará dicha Información Confidencial de acuerdo con los términos del presente Contrato. La Parte Receptora limitará el uso y acceso de sus empleados o Representantes a la Información Confidencial, si su uso o acceso a dicha Información Confidencial fuera necesario para llevar a cabo el propósito del presente Contrato. La Parte Receptora, mediante los medios adecuados, evitará la divulgación, publicación, exhibición o uso no autorizado de toda Información Confidencial. Sin limitar la generalidad de lo anterior, la Parte Receptora les exigirá a todos los empleados, representantes o contratistas que tengan acceso a la Información Confidencial que, antes de dicho acceso, celebren un Contrato de Confidencialidad que brinde, al menos, la misma protección de la Información Confidencial que la provista por esta sección. El VAR no podrá eliminar ninguna marca registrada o derecho de autor, derecho restringido, derecho limitado, derecho de propiedad intelectual o aviso de confidencialidad incluido o pegado a los Productos, ni materiales de promoción o cualquier otra Información Confidencial de la EMPRESA, y reproducirá todos aquellos avisos en todas las copias de los Productos, material de promoción o Información Confidencial de la EMPRESA que el VAR realizara en conformidad con el presente Contrato.
8.4 Desagravio por Mandato Judicial. Se acuerda expresamente que la violación de las Secciones 3 y 8 del presente Contrato por parte del VAR le provocarán un daño irreparable a la EMPRESA y el VAR reconoce que no habría un recurso legal adecuado para subsanarlo. Por lo tanto, además de todos los recursos legales disponibles, la EMPRESA tendrá derecho a un mandamiento judicial preliminar u otro recurso de equidad o medida provisional de cualquier tipo, sin necesidad de abonar una fianza o garantía en relación con los mismos para evitar cualquier otra violación de este Contrato u otro uso no autorizado de sus Productos y de su Información Confidencial; o bien para conservar las pruebas pertinentes al respecto.
