Translation - English Agreement on the Establishment of a Fixed-term Land Lease
ABC Co., Ltd. (the Lessor; hereafter “Party A”) and XYZ Co., Ltd. (the Leaseholder; hereafter “Party B”) enter into an Agreement on the Establishment of a Fixed Term Land Lease (hereafter the “Agreement”) regarding the land described in Appendix ”Inventory of the Property” (hereafter the “Land”).
(Purpose)
Article 1 Party A shall establish for Party B a fixed term land lease (hereafter the “Lease”) as stipulated in Article 22 of the Act on Land and Building Leases (hereafter the “Act”) for the Land, for the purpose of ownership of the building by a subleasing company of Party B (hereafter the “Building”).
2 With respect to this Lease, there shall be no renewal of the agreement (including by request for renewal and continued use of the land) and no extension of its duration due to the construction of buildings.
3 Party B may not request that Party A purchase buildings and other structures on the Land at the expiration of the period specified in Article 2.
(Period)
Article 2 The period of the lease shall be from April 1, 2021 to March 31, 2031.
2 Party A shall deliver the Land in question to Party B on the first day of the period set down in the preceding paragraph.
(Rent)
Article 3 After the lease start date specified in Article 2, Party B shall pay Party A rent as follows.
(1) 1 JPY per square meter of listed surface area during the site development and preparation period lasting from April 1, 2021 to May 31, 2022.
(2) Monthly rent of 49.50 JPY per square meter of listed surface area during the construction period lasting from June 1, 2022 to March 31, 2023.
(3) Monthly rent of 99 JPY per square meter during the period from April 1, 2023 to March 31, 2031. However, the above unit costs per square meter will be determined in reference to the site area after the public notice of the completion of construction.
2 By the last day of each month, Party B shall pay rent for the following month via bank transfer to an account at a financial institution specified by Party A, and Party B shall pay the transfer fees.
However, the rent for the month in which the lease begins shall be paid by the date of delivery of the Land.
3 If the month in which the lease begins or the month in which the lease ends is less than a full month, the rent for that month shall be prorated. However, any fraction of a yen shall be rounded down.
(Revision of Rent)
Article 4 If the amount of rent as described in Article 3 becomes incompatible with value of the Land through increases or decreases in taxes or other public dues or through other financial circumstances, or it becomes incompatible with rent, etc. of surrounding and similar properties, then rent shall be revised after consultation between Party A and Party B.
(Limitations on Transfer of Ownership of the Land)
Article 5 If Party A transfers rights of ownership for the Land through sale or exchange, Party A must obtain prior written consent from either Party B or Party B’s subleasing company. Even with said consent, the new owner shall inherit all rights and responsibilities of Party A as set forth in this Agreement.
(Obligation of Party A to Cooperate)
Article 6 In the event that Party B’s subleasing company constructs the Building and needs to obtain the authorization of the competent authorities in order to conduct business, Party A shall provide cooperation for the procedures undertaken by Party B and Party B’s subleasing company.
(Prohibitions Pertaining to Party A)
Article 7 After the conclusion of this Agreement, Party A shall not make the Land available for sale or purchase, or make it subject to mortgages (including revolving mortgages), superficies, leasehold rights, or any other rights that have priority over Party B until Party B’s subleasing company has completed title registration for the Building.
2 If any mortgage (including revolving mortgages), superficies, leasehold, or any other rights that have priority over Party B have been established with respect to the Land at the time of this concluding Agreement, Party A must relinquish all of these rights before the start of construction.
(Termination of Agreement Due to Force Majeure)
Article 8 This Agreement shall be terminated if the Land is lost or substantially damaged and becomes unusable due to natural disaster or other force majeure for which neither Party A nor Party B is responsible, or if the Property is expropriated for public works and the purpose of this Agreement cannot be achieved.
2 In the event that building certification or the necessary permits and licenses for the construction of the Building cannot be obtained, or in the event that construction of the Building is not possible due to opposition from neighbors or various groups, orders from government authorities, etc., or for any other reason not attributable to either Party A or Party B, Party A and Party B shall be able to cancel this Agreement, and both Party A and Party B shall bear the full cost of their individual contributions made prior to the cancellation of the Agreement.

7.1 Findings from this Project
7.1.1 Demonstration of Safety
(1) Details of the demonstration
When implementing CCS, it is important to alleviate all earthquake-related concerns by using collected data to examine and show that stored CO2 does not leak and earthquakes will not affect stored CO2 as well as CO2 injections do not cause earthquakes. In this project, a series of concrete measures for items listed in “For safe implementation of CCS demonstration work” (August 2009) shown in Table 7.1 1 were enacted in order to demonstrate and verify that CCS is a safe and secure system.
In terms of equipment, safe and expedient measures for abnormalities were implemented by equipping an emergency shut-off system (primary equipment and individual equipment) for separation, capture, and compression equipment, implementing emergency shutdowns based on large-scale earthquake detection, installing emergency shut-off valves and check valves on injection wells and installing gas detectors (CO2, combustible gas, toxic gas), etc.
In terms of storage technology, a variety of monitoring methods were employed during CO2 injection and monitoring for any CO2 injection related abnormalities by understanding the behavior of injected CO2 (movement, spread), understanding the state of potential earthquakes in the storage site and vicinity, observing heat and pressure in the injection wells, conducting marine ecology surveys, observing flow conditions in the surrounding ocean, examining water quality, substrate, plankton, and benthic organisms via water and bottom sampling, and using camera footage of the ocean floor to observe substrate organisms and watch for bubbling (refer to Chapter 4).
In addition to dispelling concerns over earthquakes since no changes in the potential for injection-induced earthquakes were observed, these results confirmed no observable abnormalities in temperature and pressure behavior inside the wells, that the injected CO2 remained in the storage layer as predicted, no changes in the marine environment, and no CO2 leaks nor risks of leaks.
CO2 injection in this project was determined to have been conducted safely based on the above confirmations. Going forward, we will continue to conduct monitoring, organize surveillance plans and the organization of surveillance items necessary for implementing CCS, and consider appropriate surveillance plans.
(2) The 2018 Hokkaido Eastern Iburi earthquake
The 2018 Hokkaido Eastern Iburi earthquake occurred at 03:07 on September 6, 2018. The Japan Meteorological Agency reported a 6.7 magnitude earthquake with an 37m deep epicenter in Central-Eastern Iburi. The Tomakomai CCS demonstration project center detected tremors with an intensity of 5.
The Tomakomai CCS demonstration project center has incorporated a safety system to shut off equipment when detecting tremors of 150 gal or greater. When the 2018 Hokkaido Eastern Iburi earthquake occurred, however, the CO2 supply gas to the Tomakomai CCS demonstration project center had been stopped since 02:25 on September 1 due to factors at the CO2 gas supply source, so surface facility operations and injection work was already paused when this earthquake occurred and it caused no emergency shut down. Also, the earthquake caused no observable damage or abnormalities in demonstration project equipment.
Stratum pressure and temperature values for both injection wells, IW-2 for the Moebetsu Formation and IW-1 for the Takinoue Formation, were continuously monitored, and, while the temporary blackout resulted in some damaged data, collection resumed after power was restored. The same trends from before the blackout continued and because conditions were similar to previous injection stoppages, no data suggesting CO2 leaks was verified. Also, the injection site constantly monitors micro-seismic activity and none was detected (none have been detected since injection commenced).
In 2011, before this project commenced, the effects on stratum when conducting 750,000 injected tonnes (250,000 tonnes annually over 3 years) were evaluated and the impossibility of slippage along cracks in the bedrock, etc. (generates micro-earthquakes) was thoroughly verified. Also, after the 2018 Hokkaido Eastern Iburi earthquake occurred, a CO2 behavior simulation based on actual injection results was carried out and stress changes at the earthquake’s epicenter were calculated to be approximately 1/1,000 the pressure change (multiple kPa) exerted on the crust by tidal forces.
The above items were reported on during the Review Meeting for the Tomakomai CCS Demonstration held on October 19, 2018. Members reached a common consensus that there was no connection between CO2 injections and the causes of this earthquake and summarized their findings in the Research Report on the Effects, etc. to CO2 Reservoirs by Hokkaido Eastern Iburi Earthquake, which was published on the JCCS homepage in November, 20181.
7.1.2 CO2 Capture/Injection
Over the course of approximately 44 months, from April 2016 to November 2019, the following main findings were obtained from results of pressure demonstration projects using the capture/injection facilities.
Three performance evaluation tests (December 2016, October 2017, May 2019) for capture energy were conducted and an actual value of 1.16 - 1.20 GJ/t was achieved, below the target value of 1.22 GJ/t that accounted for heat loss, etc. from the amine reboiler.
During the demonstration project, the amine solution added to the system at the start of capture facility operations did not require any amine degradation removal or amine regeneration, nor did it require replacing. Few degradation products in the amine solution (heat-stable salts) were generated, no significant change to the CO2 absorption capabilities (rich amine loading, semi-lean amine loading) or the CO2 emission capacity (lean amine loading) were observed, and solution performance was stable.
The CO2 compressor control system was modified and automatic adjustments to captured CO2 flow rates and pressure fluctuations prevented captured CO2 discharges from the vent stack, making it possible for the injection facilities to stably inject the full amount of captured CO2. This project also demonstrated the possibility of stably conducting simultaneous injection into two reservoirs.
The efficacy of safety measures for capture/injection facilities was demonstrated for the emergency shutoff system, safe operations, aseismic facility design, and seismic countermeasures during emergencies.
Additionally, one portion of the facilities experienced issues, but appropriate measures to clarify causes were enacted and compiled in a document as Example Issues. The configured document is handled as an internal database. Furthermore, results from understandings on the correlation between capture rate and capture energy, proposals for further reductions to capture energy, etc. can contribute to optimal facility design when implementing CCS.
7.1.3 CO2 Storage and monitoring
Injections into the Moebetsu Formation began on April 6, 2016, injecting 300,012 tonnes CO2 until November 22, 2019. Because injection conditions were good, the maximum pressure measured by the PT sensor was 10.07 MPaG, considerably lower than the 12.63 MPaG upper limit set to avoid destruction of the Moebetsu Formation shield layer, enabling injection at designed levels.
Injection of CO2 began at the Takinoue Formation on February 6, 2018. Conditions were worse than expected for test injections conducted between February 6, 2018 - February 23, 2018 and July 31, 2018 - September 1, 2018. The injection rate was adjusted so that the maximum pressure level measured by the PT sensor rested considerably under the maximum 38.00 MPaG set to avoid destruction of the Takinoue Formation shield layer. Therefor, a total of 98 tonnes ended up being injected. Because the rock was primarily tuff, not magma and tuff breccia as expected, uncertainties due to lithofacies in injectivity estimates for volcanic rock formation were an issue.
Since the start of injections, no microseisms or natural earthquakes near the reservoirs that would suggest a connection to injections have been detected. This includes the time both before and after the main shock of the 2018 Hokkaido Eastern Iburi Earthquake.
After a seismic survey in 2017, the state of existing CO2 in the Moebetsu Formation was studied and verification that CO2 was contained inside the reservoir as previously expected was obtained. The injected CO2 is considered to have stayed only in the upper area of the reservoir with no abnormalities such as leaks to the outside of the reservoir. On the other hand, cumulative CO2 injected into the Takinoue Formation was extremely low at 98 tonnes and a seismic survey was unable to verify the state of the existing CO2. This is believed to be because variations in physical properties are below the minimum detection limit of seismic surveys.
Results from marine environment surveys conducted since 2016 did not differ drastically from baseline survey results (2013 - 2014), nor were any trends seen that deviated significantly from them. Measurements taken in the spring of 2016 and summer and winter of 2017 exceeded the old standard curve of baseline surveys, but results from verification surveys, etc. could not confirm any CO2 leaks or risks of leaks. Determinations on whether measurements exceeded the new baseline were conducted after the summer of 2018, but values exceeding the baseline were not observed in 2018 or 2019.
Monitoring to date has not detected any pressure and temperature abnormalities in the CO2 reservoir nor microseisms or earthquakes connected to either CO2 injections or the reservoir and has verified that the injected CO2 remains inside the reservoir. Long-term reservoir behavior prediction simulations forecast that the injected CO2 will remain in the reservoir for at least 1,000 years. Also, marine environment surveys did not identify any changes from pre-CO2 injection conditions nor any phenomena such as CO2 leaks or risks of leaks. Results of these monitoring techniques confirmed that CO2 from this project is stored safely.
