De privaatrechtelijke persoon die bijzondere of uitsluitende rechten geniet wanneer hij een activiteit uitoefent als bedoeld in titel IV Wet Overheidsopdrachten. De bijzondere of uitsluitende rechten zijn rechten die voortvloeien uit een door een bevoegde overheid verleende machtiging op grond van een wettelijke, reglementaire of administratieve bepaling die tot gevolg heeft dat de uitoefening van een van de in deze titel bedoelde activiteiten aan een of meer entiteiten voorbehouden blijft waardoor de mogelijkheden van andere entiteiten om dezelfde activiteit uit te oefenen wezenlijk nadelig worden beïnvloed.

When deciding between easy and pro, err on the side of pro. Most questions will be pro.

* Note: non-member askers are not given the option of entering 'pro' questions; the only way for their questions to be classified as 'pro' is for a ProZ.com member or members to re-classify it.
