the court of the last instance 説明： 確定判決を出した裁判所のことです。 英語ではlast や final を最高裁など、これ以上上告できない裁判所のことにも使うので紛らわしいですが、高裁や最高裁の判決が出ていなければ、地裁にも「最後に判決を出した裁判所」即ち「確定審」の意味で the court of the last instance は使えます。ただし、文脈で最高裁のことではないと分かるようにしておく必要があります。また、控訴などが話題になっていないなら、the court that delivered the ruling で十分な場合もあると思います。 Suggestion には使いませんでしたが、final が最高裁には限らない例を上げておきます。（定義ではなく、例文の方が参考になると思います。） http://dictionary.cambridge.org/dictionary/english/final-and... |
