Como ha apuntado Lenaerts (1994: 14), el Tratado intenta alcanzar un equilibrio entre la colaboración impulsada por las medidas de fomento comunitarias y **la reserva del núcleo de poderes*** conferidos a los Estados miembros. Por tal motivo, el apartado 4 del artículo 149 excluye cualquier “armonización de las disposiciones legales y reglamentarias de los Estados miembros”. Con todo, esto no impide que las medidas de fomento iniciadas desde las instituciones comunitarias puedan acabar produciendo una armonización del contenido de la enseñanza o de la organización de los sistemas educativos en los distintos Estados.
