(Garner's Dictionary of Legal Usage, Oxford, 2004) The verb "subrogate to" certainly exists but perhaps "assuming" sounds more natural. Here are some examples of how "to subrogate to..." is used: The court held that the bank could subrogate to the rights of the drawer against the payee.
