派遣社員が採用されることを希望しない場合には、派遣契約による受入継続が可能です。

A phase from a manual describing policies regarding temp. staff. This section refers to employment obligations that may be incurred under the Japanese ordinance 政令26業務. The manual previously explained that if you employ someone for too long, you need to take them on as a full time employee. So, I'm not at all sure what this means in that context.

意味的にはMaynardさんの言っていることと同じかもしれません。ただ、ここで会社側が言いたいのは、派遣社員が採用を望まない時には「派遣社員が継続を希望できる」のではなく、「会社側が契約ベースで派遣を受け入れても良い」ということだと思ったので、会社を主語にした文で、回答してみました。

Just guessing, but it sounds like a convenient loophole to me. What person in their right mind would "volunteer" to continue doing the same work for LESS pay and ZERO benefits.

agree casey : Actually, this same kind of situation arose at my former place of employment. The reason was to keep from having to do サービス残業. With the temp contract at least you didn't have to work overtime for free.

agree wallacs2 : I've noticed a trend of these kind of phrases cropping up in employment contracts lately. サービス残業 is a common one instead of saying 無給残業. Similar to "right to work" clauses in English contracts. All a bit shady IMO.
